Terms & Conditions
1. Identification
The EnbiCare service is provided by Enbiente — Energia e Ambiente, Lda., with registered office at Rua Santa Isabel Lote 2, Cave, Repeses, 3500-726 Viseu, Portugal (hereinafter "Enbiente").
2. Scope
These Terms & Conditions govern access to and use of the EnbiCare public website (enbiente.com), as well as the subscription of EnbiCare service plans described on the website and made available through Enbiente's official store.
3. The EnbiCare service
EnbiCare is a continuous technical support service targeted at institutions, with annual plans covering preventive maintenance, technical checks, specialist support and improvement recommendations. The service is provided according to the contracted plan (Standard or Premium) and the published conditions.
4. Subscription and contracting
Subscription of an EnbiCare plan is carried out at Enbiente's official store at enbiente.com. The contract is formalised once written confirmation is exchanged between Enbiente and the client institution.
Before contracting, the institution may request commercial clarifications via the contact form available on the website.
5. Prices and billing
Plan prices are published on the website and at the official store and cover technical labour only. Materials and equipment are billed separately according to actual consumption.
Published prices apply to institutions in the Viseu municipality. For other locations, travel is billed separately according to distance and time spent.
Invoices are issued monthly, unless otherwise agreed between the parties.
6. Contracted technical hours
Each plan includes a defined number of annual technical hours or a monthly visit limit, in accordance with the published terms. Hours exceeding the contracted limit are billed as extra hours, at the published rate per plan (€75/h Standard, €50/h Premium).
7. Service delivery
Enbiente undertakes to:
- Carry out technical visits according to the agreed calendar;
- Provide incident response time in accordance with the contracted plan;
- Document each intervention in a technical report;
- Provide improvement recommendations whenever applicable.
8. Client institution's obligations
The institution undertakes to:
- Ensure technical access to the facilities for interventions to take place;
- Promptly communicate relevant changes in equipment or contacts;
- Pay invoices within the agreed deadlines;
- Not request from the technical team interventions outside the contracted scope.
9. Liability
Enbiente is liable for the services rendered in accordance with applicable law. Enbiente is not liable for damages caused by equipment whose maintenance is not included in the contracted plan, nor for interventions performed by third parties without Enbiente's knowledge.
10. Term and renewal
EnbiCare plans have an annual duration and renew automatically for equal periods unless either party terminates in writing with at least 30 days' notice prior to the end of the current period.
11. Termination
The contract may be terminated by either party in case of breach by the counterparty, by means of written notice with 30 days' prior notice and an opportunity to remedy.
12. Data protection
The processing of personal data arising from the use of the website and the provision of the EnbiCare service is governed by the Privacy Policy published on this website.
13. Changes
Enbiente may update these Terms & Conditions. Changes enter into force on the publication date. For active contracts, material changes are communicated in advance to the client institution.
14. Governing law and jurisdiction
These Terms & Conditions are governed by Portuguese law. For the resolution of any dispute, the court of the Comarca de Viseu has jurisdiction, with express waiver of any other.
